PINE RIVER RANCHES LANDOWNERS ASSOCIATION, INC.

MONTHLY MEETING – FEBRUARY 15, 2017

LEROY RESIDENCE:  18 PINE RIVER RANCH CIRCLE, BAYFIELD, CO 81122

 

The meeting was called to order by President Jim Clay.  Board members present:  Angie Pommier and Pat Le Roy.  John Dustin and Waterman Orsmby lll were absent due to illness.

 

Guests present:  Shirlene Hendrix, Shane and Annette French, and Steve Harris.

 

The Minutes from the January 10, 2017, meeting were emailed to the Board members for additions and/or corrections.  After the additions and/or corrections were made they were emailed to the Board for final approval.  The minutes were posted at the mailboxes and on the website.  Angie Pommier moved that the minutes be approved as corrected, second by Pat Le Roy.  Vote to approve 3-0.

 

Pat Le Roy presented the Treasurer report:  Balance in the Winter Account is $2157.57.  One check was written to Neils for snow removal for $1200.00.  This invoice was emailed to all board members for their approval.  Payment was made prior to this meeting to avoid late payment fees.  Angie Pommier moved that this payment be approved, second by Pat Le Roy.  Vote to approve 3-0. The balance in the General Account is $47188.12.  The following checks cleared:  Neils, $260.00 snow removal;  Pat Le Roy $76.86 for office supplies. Angie Pommier moved that the Treasurer report be approved, second by Pat Le Roy.  Vote to approve 3-0.

 

Pat Le Roy moved that $4000.00 be transferred to the Winter Account, second by Angie Pommier.   Vote to approve 3-0.

 

Pat Le Roy presented an invoice for $125.00 from the attorney, Lindsey Nicholson.  This  invoice is for her meeting with Pat Le Roy to hand over the CC&Rs and By Laws committee members contact information and a letter stating that the committee has the authority to contact the attorney for assistance and guidance as needed.   They discussed any new laws pertaining to HOAs that the Board needs to address.  Angie Pommier moved that the invoice be approved for payment, second by Pat Le Roy.  Vote to approve 3-0..

 

2017 ANNUAL ASSESSMENT – PAYMENTS AND DELINQUENT NOTICES

 

More payments have been received to date than in years past.  Pat Le Roy mailed 19 Delinquent notices covering 23 lots for a total of $7394.00.  These notices were mailed February 4, 2017.

 

OLD BUSINESS:

 

GWEN GOLD – No building permits have been received as of today.

 

SOLAR PANELS – STEVE HARRIS – Steve reported that he had talked with his contractor about adding additional panels.  According to the contractor the roof will not support more panels and additional panels will extend past the eaves.  At the last meeting Steve indicated that he was willing to paint the shiny frame and that the colors available are aluminum, silver, and black.  He is waiting for a city inspection.  Jim Clay offered to help paint the frame in May and would assume his own liability.

 

VIOLATON LETTERS – Letters were mailed to the Landowners who had either abated the violation or had presented a plan of action.

 

Shane French reported that he had met with La Plata County officials, Butch Knowlen, Marianne Spirock and Mr. Doyle.  They determined that Shane was not conducting business on his property but he did need a land use permit, an over the counter permit.  He may dump firewood on his property and work on his trucks.

 

Shane also reported that 3 other landowners, Chris Kaufmann, John Dustin, and Barb Wickman will be receiving letters regarding in home businesses.

 

In response to the Violation letter that was dated August 24, 2017, Shane stated the following:

CC&R #16 – he will cover the wood pile with a tarp

CC&R # 18 – he is not running a business from his home, but does need to purchase a land use permit.  He will submit a copy of this permit to the Board.

 

Shane also reported that there had been an incident recently where there were fishermen fishing the river unaccompanied by a landowner and some had no fishing license.  This was reported to the Division of Parks and Wildlife and citations were issued.  A charge of trespassing was included.

 

Shane stated that the CC&Rs do not clearly state the fishing easement width along the river.  Pat Le Roy presented a copy of the Plat for Pine River Ranches Subd. No. 2.  It clearly states that the access easement width is 30ft from the high water line and a second access easement of like width along the east boundary of Lots 91 (the pond) and lots 11 and 12.  The question is:  Does the plat supersede the CC&Rs?  Pat Le Roy will contact the attorney for a written opinion.

 

ASPHALT ROAD –  Jim Clay was not able to find any patching material.  Shane said that he still has a few bags and Jim may help himself to the material.

 

MAILBOXES – no update but Pat Le Roy is still hoping that a free cluster will be available from the post office.

 

DISCUSS VIOLATION FINES GUIDELINES – No discussion at this time.  The attorney had mentioned to Pat Le Roy that without a system of reasonable fines for violations, there is no consequence for violations.  The attorney stressed that fines have to be reasonable.  Jim Clay indicated that this is an agenda item for the annual meeting.

 

INTERNET –  No update to report

 

CC&Rs COMMITTEE – The committee is meeting every two weeks.  Committee members are:  Angie Diedrich, John Wickman, A.  J. Boyle, Stephanie McCain, and Chip Burkett.

 

WASTE MANAGEMENT – There will be no refunds for no trash removal due weather related conditions.  Jim Clay did inquire, at Shirlene Hendrix’s request, about a group rate for the subdivision.  They are looking into it.

 

NEW BUSINESS:

 

PAYPAL – A landowner had inquired about having PayPal available for paying annual assessments.  The Board will check it out.

 

VACATION RENTAL – Don Schwatken asked for clarification about using his home as a vacation rental and if there was anything in the CC&Rs that would prohibit it.  The only reference to rentals is that the landowner is responsible for any damage a tenant may cause to HOA property.  Pat will contact John Dustin before replying to Don Schwatken.

 

Pat Le Roy reported that she had visited with Glen Watson and that he has concerns about the amount of water and mud from driveways running across Ludwig Drive.  The ditches will be cleaned again when the dust abatement is done.

 

DISCUSSION:

 

POTHOLES – Ludwig Drive from the bridge to the Y has major potholes.  The consensus after some discussion was that filling the potholes cannot wait until May.  Pat Le Roy moved that up to $3500.00 be spent on material and labor, second by Angie Pommier.  Vote to approve 3-0.  Pat mentioned that with this added expense, it may affect whether or not a fall grading of this area will be done.  Angie Pommier will contact Gosney for a

bid.

 

Annette and Shane French asked that the Board be consistent when issuing CC&R violations.  They had driven around the subdivision and found that the Board members themselves have violations that have not been addressed.  When asked directly by Pat Le Roy, they felt that she is in violation of CC&R # 17.
